INS Regulations

For New Concept Group to obtain an H1B visa for you as our prospective employee, you must have at least a bachelor’s degree in a technical field AND five or more years experience in Information Technologies showing increasing skills and responsibility. These are the minimum standards. Without at least that much experience, you wouldn’t be a candidate for New Concept Group.
  • The first step is for you to provide the information on the H1B Checklist. Some of it is easy to provide–some takes a little longer, but all of it is needed for us to begin the process.

    We start with a request for the State Prevailing Wage survey unless we have other state- recognized, published sources. Once we have this information, we file Form ETA-9035, Labor Condition Attestation or LCA with the Department of Labor. If we are lucky, this only takes about a week or two to get approved.

    We also obtain a ruling on "educational equivalency." The purpose is to show INS that your degree is equal to a degree from the US. New Concept Group submits your resume, copies of your degree(s), and copies of your transcripts for evaluation.


  • Once we have the approved LCA and all of your information from the H1B check list, New Concept Group prepares the visa application and petition package and files it at the appropriate Immigration and Naturalization Service Center (INS).


  • INS sends us a Notice of Receipt and a tracking number for your application. And the waiting begins. Right now, they are approving visas in 60-90 days. If they write us back and request additional information, the process takes longer.


  • The Notice of Approval is issued by INS (they approve more than 90% of the applications). This means your H1B status has been approved and wired to your local US Consulate.


  • Go to your local US Consulate and apply for the H1B to be added to your passport. It provides you with the right to work in the US for the sponsoring employer for three years and is renewable for an additional three years.
Five easy steps. They sound simple, but they take time. We have had visas issued in as little as 10 weeks and as long as six months. But, we’ll stay in touch with you every step of the way. We can be very flexible on this end and we recommend that you stay employed or on contract in your country until your visa is in hand.
